1. Service description

FairShield provides AI-powered wage compliance checking services for Australian businesses. Our service analyses payroll data against Modern Award requirements and produces compliance reports. FairShield provides preliminary compliance checks, not legal or industrial advice. Our reports are not a substitute for advice from a qualified employment lawyer, industrial relations specialist, or registered tax agent.

2. Limitation of liability

While we endeavour to ensure accuracy, Modern Awards are complex legal instruments and our compliance engine may not capture every nuance. FairShield's total liability for any claim arising from the use of our service is limited to the fees paid by you in the 12 months preceding the claim, or $10,000, whichever is less. We strongly recommend that all findings be reviewed by a qualified professional before remediation action is taken.

3. Your responsibilities

  • You are responsible for the accuracy and completeness of the payroll data you upload
  • You must have authority to upload employee payroll data and comply with privacy obligations to your employees
  • You are responsible for reviewing findings and seeking professional advice before taking remediation action
  • FairShield reports should not be relied upon as the sole basis for compliance decisions

4. Voluntary Code disclaimer

FairShield reports are designed to assist businesses in demonstrating “reasonable steps” under the Voluntary Small Business Wage Compliance Code. However, whether a business has complied with the Code is ultimately determined by the Fair Work Ombudsman, not by FairShield. A FairShield report does not guarantee compliance with the Code or immunity from investigation or prosecution.

5. Subscription and payment

Shield Pro subscriptions are billed monthly or annually as selected. You may cancel at any time; cancellation takes effect at the end of the current billing period. Refunds for one-off Shield Check reports are available within 14 days if no report has been generated. Prices are in Australian dollars and include GST.

6. Bookkeeper partners

Shield Partner accounts are subject to additional terms. Partners must not misrepresent FairShield reports as legal advice. White-labelled reports must retain the FairShield disclaimer. Partners are responsible for their own client relationships and billing.

7. Intellectual property

You retain ownership of all payroll data you upload. FairShield retains ownership of its compliance engine, award rules data, report templates, and all intellectual property in the platform. Compliance reports generated for you are licensed for your internal use and may be shared with your professional advisors and the Fair Work Ombudsman.

8. Governing law

These terms are governed by the laws of the State of New South Wales, Australia. Any disputes will be resolved in the courts of New South Wales.
