1. Who we are

FairShield Pty Ltd (ABN XX XXX XXX XXX) (“FairShield”, “we”, “us”) operates the FairShield wage compliance checking platform at fairshield.com.au. We are committed to protecting the privacy of our users and complying with the Australian Privacy Principles (APPs) under the Privacy Act 1988 (Cth).

2. Information we collect

We collect the following categories of personal information:

• Account information: Business name, contact name, email address, phone number, ABN, state/territory.
• Payroll data: Employee names, employment type, hours worked, pay rates, classification levels, pay periods. This data is uploaded by you for the purpose of compliance checking.
• Payment information: Processed by Stripe. We do not store credit card numbers.
• Usage data: Pages visited, features used, compliance checks run.

3. How we use your information

• To perform compliance checks against relevant Modern Awards
• To generate Code Compliance Reports and Findings Schedules
• To process payments and manage your subscription
• To send you compliance alerts and award rate updates (with your consent)
• To improve our compliance engine accuracy

4. Data security

All data is encrypted in transit (TLS 1.3) and at rest (AES-256). Payroll data is stored on Australian-based servers. We implement access controls, audit logging, and regular security assessments. Payroll data is automatically deleted 90 days after your last compliance check unless you are on an active subscription.

5. Data retention

Compliance reports are retained for the duration of your subscription plus 7 years (to match the statutory lookback period). Uploaded payroll data is deleted 90 days after processing for one-off checks. Subscription customers' data is retained for the subscription period plus 90 days.

6. Third-party sharing

We do not sell your data. We share information only with: Stripe (payment processing), our cloud infrastructure provider (Australian region), and AI processing services (for classification assistance — data is not retained by AI providers). If you use FairShield through a bookkeeper partner, your bookkeeper will have access to your compliance reports.

7. Your rights

You have the right to access, correct, or delete your personal information at any time. You can export your compliance reports in PDF format. To exercise these rights, contact privacy@fairshield.com.au.
