The Voluntary Small Business Wage Compliance Code is a framework introduced by the Australian Government alongside the criminalisation of intentional wage underpayment (effective 1 January 2025). It provides small businesses with fewer than 15 employees a pathway to demonstrate they have taken "reasonable steps" to comply with pay obligations. If a business can show it followed the steps set out in the Code, it will not be subject to criminal prosecution for wage underpayment. The Code was endorsed by the Fair Work Ombudsman and is published by the Department of Employment and Workplace Relations.
